This Privacy Policy is applicable to Job Applicant of Advanced Info Service Plc., Group of Companies.
The Company recommends Job Applicant to read and understand the Privacy Policy - Job Applicant as it explains the Company's procedure for handling Job Applicant's personal data, for instance, collecting, storing, using, disclosing personal data, including other rights. Details are as follows:
1. Definitions
"Company" means Advanced Info Service Plc. Group of Companies.
"Personal Data" means any information pertaining to a the Data Subject that may identify Data Subject's identity, whether directly or indirectly.
"Sensitive Personal Data" means any authentic personal data pertaining to the Data Subject, which is sensitive and may be risky to cause any unfair practice, for instance, ethnicity, cult, religious belief or philosophy, criminal records, personal health records, disabilities, labor union information, genetic information, biometric information or any other information that may have an impact on the Data Subject in similar manner as announced by the Personal Data Protection Committee.
"Job Applicant" means any person who is applying for job and is awaiting to be considered as an employee or trainee.
2. Policy
This Policy was formulated in order to notify Job Applicant to acknowledge the objectives, along with the details concerning the requirements for collecting, storing, using and disclosing Job Applicant's personal data as well as the applicable rights related to personal data according to the law, and to meet the objectives of applying for job position (career), internship, including a consideration for employment or a trainee.
3. Sources of Personal Data
3.1. The Company shall collect job applicant's personal data directly from a paper format or an online application form made available in the recruitment websites and via e-mail.
3.2. The Company may receive Job Applicant's personal data from third party, for instance, a recommendation from current employee, agent and contractor (headhunter) that the Company uses to search for Job Applicant, and having the right to disclose Job Applicant's personal data under the law.
3.3 The Company shall collect only necessary personal data and the data collected shall be in accordance with the objectives and procedure prescribed by the law.
3.4 The Company may collect Job Applicant's sensitive personal data for the purpose of processing the job application. In proceeding with such action, the Company shall seek Job Applicant's consent prior to collecting the sensitive personal data, unless otherwise prescribed by law.
4. Use of Cookies
The Company uses Cookies to collect your personal data as prescribed in the Cookies Policy.
5. Measures to Secure Personal Data and Maintaining Data Quality
5.1. The Company recognizes the importance of maintaining the security of Job Applicant's personal data. Therefore, the Company has established measures to maintain the security of personal data appropriately and is consistent with the measures to maintain confidentiality of personal data to prevent any losses, unlawful or illegal and unauthorized access, destroy, use, modification or disclosure of personal data as well as any unauthorized use of personal data provided that it shall be in accordance with the Cyber Security Policy of AIS Group.
5.2. Any personal data that the Company collected such as name-surname, age, residential address, telephone numbers, identification card number, financial information, Job Applicant's picture or photograph, etc., which is identifiable, the Company shall carry out appropriate measures to protect the Data Subject's right.
6. Purpose of Collecting, Storing, Using and Disclosing Personal Data
The Company collects, stores and uses personal data for the purpose of verifying the Job Applicant's personal data and for employing the employee and trainee, along with meeting the human resources management objectives, for instance, manage communication channel with Job Applicant or digital recruitment channel or conducting a research, analysis and/or preparing job applicant database, including using the personal data to propose vacant job positions (career opportunity) to job applicant or for the benefit of an analysis, etc.
7. Sending, Receiving, Transmitting and Disclosing Personal Data
The Company may send, receive, transmit and disclose Job Applicant's personal data to subsidiary companies for the benefit of recruiting Job Applicant processing the to which such personal data would be protected under the personal data protection measures of the Company.
8. Right of Data Subject
8.1. Request to access to or make a copy of personal data in accordance with the requirements and procedures as specified by the Company (@ the Human Resources Department) or request to disclose the sources of personal data.
8.2. Request to adjust inaccurate or incomplete personal data and update such data.
8.3. Request to delete or destroy personal data, except the case where the Company has to comply with the law.
8.4 Request to withdraw Job Applicant's consent with the Company to collect, store, use and disclose personal data, except there is a limitation under the law or is subject to an obligation under the agreement with the Company. In this regard, any withdrawal to any consent given to the Company may have direct impact on the Job Applicant as the Company is unable to use personal data to suggest vacant position, therefore, it is recommended that Job Applicant study/inquire any impacts before withdrawing the consent.
8.5 Request to suspend the use of personal data in case the Company is in the process of conducting an investigation in accordance with Data Subject request to amend or oppose any use Data Subject's personal data.
8.6 Request to oppose any collection, storage, use and disclose any of Data Subject's personal data, except where the Company has to comply with the law or to meet human resources management purposes.
8.7 Request to receive Data Subject's personal data, including send or transmit it to other data controller when it is possible to do so via automatic procedure, except the technical environment does not permit the Data Controller to do so.
8.8 File a complaint with the Personal Data Protection Committee as prescribed under the law.
The abovementioned rights that Data Subject exercised may be suspended or is limited under applicable law and, in some instances, the Company may necessarily have to reject Data Subject request or unable to act in accordance with Data Subject request, for instance, to comply with the law or court order, for the purpose of public interest, or Data Subject request may violate other people rights or freedom, or for the purpose of managing human resources according to the rules and regulations of the Company as required by law, etc. If the Company rejects the abovementioned requests, the Company shall inform you the reason for such rejection.
9. Retention Period for the Personal Information
The Company shall maintain Job Applicant's personal data within the period as deemed necessary in order to meet the objectives of human resources management or in accordance with the period as specified by law. In this regard, when the period for maintaining the personal data is ended, the Company will delete, destroy or make Data Subject's personal data non-identifiable.
10. Amendment of the Policy
In case of an amendment to this Privacy Policy, the Company shall announce the newly amended Privacy Policy in its website so that the Job Applicant may occasionally review any changes to the Privacy Policy provided that the newly amended Privacy Policy shall be effective on the date of the announcement.
11. Data Protection Officer
The Company has proceeded in accordance with the Data Protection Act B.E. 2562 by appointing Data Protection Officer ("DPO") to conduct inspection on the Company's operation concerning collecting, using and disclosing personal data to stay consistent with the Data Protection Act B.E. 2562, including related data protection regulations. In addition, the Company has also promulgated rules and gave orders to relating parties to comply therewith in order to proceed in accordance with the specified policy governing personal data protection, along with the Company's policy announced by Personal Data Protection Committee and Cyber Security Policy.
